The protection of human rights necessarily involves the resolution of a significant number of controversies on questions with social, moral, or ethical dimensions. On such questions, it is inevitable that there will exist a certain level of disagreement in society, and the more diverse that society is, the greater the extent of the likely disagreement. It is also highly unlikely that the views of society on such controversies will remain constant over time. Consequently, rights provisions in international human rights instruments and domestic constitutions tend to be drafted in very vague language, leaving significant discretion to the judges charged with interpreting them.
