In this paper, we analyze e-Health system from the human-rights based approach, taking into consideration is technical and legal implications; this is important, multidisciplinary approach gives deeper understanding of the problem. Thus an overview of the E-Health legal environment is provided so as to provide a reader with the overall context of electronic healthcare. Technical details of functioning of e-Health systems is also given, with a view to give clear picture of existing risks. As we see the trend of the changing relations between medical professionals (doctors, nurses and other personnel of medical facilities) and patients, we paid specific attention to the issues of data protection, existing advantages and limitations for implementation in E-Health systems. It is shown that COVID-19 led to more extensive application of e-Health system and brought new perspectives to the process. We come to the conclusion that artificial intelligence methods are beneficial for medicine, and from the technical point of view can already provide valuable results. However appropriate legal framework is necessary to ensure the possibilities of control, verification and second opinion by human (doctor).
